In view of the confusion and controversy over the proposals in the Union Budget regarding levy of tax on Non-Resident Indians, the Ministry of Finance on Sunday evening issued a clarification.

The Finance Bill 2020 proposed to amend Section 6 of the Income Tax Act 1961 to reduce the period of stay in India as 120 days from 182 days for claiming NRI status.

The Bill also had a proposal to add a provison in Section 6 to state that an Indian citizen will be deemed to be resident in India, if he is not liable to be taxed in any country or jurisdiction.

As per the present Income Tax Act, Indian citizens of persons of Indian origin are treated as Indian citizens

if they stay for 182 days or more in India. This period is sought to be reduced as 120 days with effect from April 1, 2020.

‘Can Death Row Convicts In Same Case Be Separately Hanged?’ Delhi HC Reserves Order In Nirbhaya Case

Justice Suresh Kumar Kait of Delhi High Court is hearing petition by Tihar Jail authorities against the Trial Court’s stay on the execution of Nirbhaya case convicts.

Justice Suresh Kumar Kait heard the arguments for over three hours on a special Sunday sitting starting from 3 PM.

During the proceedings, it was argued by Solicitor General Tushar Mehta that the Trial Court erroneously interpreted Rule 836 of Delhi Prison Rules, to hold that pendency of mercy petition of even one of the convicts would automatically stay the execution of the death sentence all the other co convicts.

The judgment of the Supreme Court in Shatrughan Chauhan v. Union of India was cited to argue that the delay caused in hanging of a death row convict, whose mercy plea has been rejected, has a de-humanizing effect on such a convict.
